While private entities may own land adjacent to bodies of water, by the act, they do not inherently own the water itself.

Under the proposed plan:

  • Existing borehole owners must register their systems with exact geographical siting data.
  • A geosite identifier will be required before drilling for new installations.
  • Drillers must submit all technical data, including depth, within 2 months.
  • Yield tests and sustainable water usage reports may be required.

The Public Backlash and the Way Forward

These proposals have generated severe backlash from ratepayer groups, who argue that the government should first fix failing municipal water systems—the major reason stated for installing a borehole – before tightening rules on residents. They urge leniency, at the very least for those boreholes already in operation or in areas where the municipal supply is either unreliable or non-existent. However, government experts state that it is essential to have complete data as to the degree of extraction against aquifer reserves to prevent over-utilization and account for regeneration times.

Failure to comply with the proposed rules could reportedly lead to heavy penalties, including fines, imprisonment, or both.
